Terms of Use, Disclaimer of Liability & Jurisdiction

1. The Platform is only an intermediary

awaskart.com (the “Platform”) is an online property-listing and advertising platform operated by Namo Shivay Infratech Private Limited (the “Company”). The Platform only provides a medium through which sellers, buyers, agents, brokers and partners can publish and discover property listings. The Company is NOT a party to any discussion, negotiation, agreement or transaction between any users, and it does not own, sell, purchase or guarantee any property listed on the Platform.

2. No liability of the Platform — money, fraud, failure or claims

The Company and the Platform shall NOT be responsible or liable, directly or indirectly, in any manner whatsoever, for:
• any money paid, received, advanced, deposited or refunded by or between any parties, including any token, advance or booking amount;
• any fraud, cheating, forgery, misrepresentation, concealment or default by any seller, buyer, agent, broker, partner or other third party;
• the failure, delay, cancellation or non-completion of any transaction or dealing;
• the title, ownership, possession, approvals, quality, measurement or legality of any property, or the correctness of any listing;
• any claim, loss, damage, expense or dispute of any nature arising out of or in connection with the use of the Platform.
Every user deals entirely at his or her own risk and must, before paying any amount, independently verify the title and documents of the property, visit the property personally, and transact only through a properly stamped and registered agreement.

3. Payments are strictly between the parties

The Platform does not collect, receive, hold or transfer any transaction amount. Any payment made by one user to another is made directly between those parties at their own sole risk, and no such payment shall create any responsibility of, or any claim against, the Company.

4. Accuracy of your information

You are solely responsible for the truth, accuracy and legality of every listing, photograph, document and statement that you publish or communicate through the Platform, and for keeping your account credentials confidential. The Company may remove any listing or account that appears false, unlawful or misleading, without notice.

5. Confidentiality — no misuse of contact details

Contact numbers and personal details visible on the Platform are disclosed only for the specific property enquiry for which they are shown. You shall keep such details confidential, use them only for that genuine enquiry, and shall not copy them in bulk, sell, share, forward or use them for marketing, spamming or any other purpose whatsoever.

6. Governing law & jurisdiction — Meerut only

These terms are governed by the laws of India. Any dispute of any nature arising out of or in connection with the Platform, its use, or any dealing facilitated through it shall be subject to the EXCLUSIVE jurisdiction of the Hon'ble District Courts at Meerut, Uttar Pradesh, and you agree not to institute any proceeding in respect of any such dispute before any other court, tribunal or forum.

7. Acceptance is mandatory and is recorded

An account can be created and used only after accepting these terms. Your electronic acceptance (ticking the acceptance box and clicking “I Accept”) is recorded with the date, time and terms version and is binding on you in the same manner as your signature. If you do not agree with any part of these terms, please do not create or use an account. The Company may issue an updated version of these terms, in which case a fresh acceptance may be required to continue using the account.
